Defense personnel loan default action follows the same lending rules that apply to every other borrower. A missed EMI leads to reminders, then a formal overdue status, a credit report impact and, if dues stay unpaid, recovery steps. Service rules, posting changes and pay arrangements can add questions of their own, so this guide explains the general process and where to get help. It is general information, not legal advice.
What happens first when an EMI is missed?
Most lenders start with SMS, email and calls. Your lender then reports the late payment to credit bureaus. CIBIL states that late payments are viewed negatively by lenders, so even a short delay can matter for future loans. Our post on how one missed EMI compares with a short delay goes deeper.
When does a loan become a non performing asset?
RBI states that a term loan becomes a non performing asset when interest or an instalment stays overdue for more than 90 days. After that point lenders treat the account as stressed and usually step up collection. The earlier you talk to the lender, the more options you tend to have.
| Stage | What usually happens |
|---|---|
| Overdue up to 90 days | Overdue, but not yet classed as non performing. Reminders and calls are common. |
| Overdue more than 90 days | Treated as a non performing asset under RBI norms. Recovery action can follow. |
This table is a general guide. Timelines differ by lender, loan type and your agreement.
Are there special rules for uniformed services?
We could not confirm on an official RBI, SEBI or similar source any lending rule that treats defense personnel differently from other borrowers, so we do not claim one here. Questions such as how pay is credited, what a unit or finance office can do, or how service regulations apply to personal debt depend on your own service rules. Please check these with your unit finance office or a qualified lawyer.
What can recovery agents do and not do?
RBI has told banks that their agents must not use intimidating methods. In its circular, RBI says banks must ensure agents carry an authorisation letter and identity card and that complaints about abusive practices will be viewed seriously. You can read more in our guides on recovery rules for Indian borrowers and your rights during recovery calls.
- Ask the caller for their name, the lender they represent and their authorisation.
- Keep a record of dates, times and what was said.
- Stay polite and ask for any settlement or restructure offer in writing.
What should you do if you cannot pay on time?
- List every loan, EMI, due date and outstanding amount.
- Contact the lender before the 90 day mark and explain your situation.
- Ask what options exist, such as a revised schedule, and get the terms in writing.
- If you must choose, give priority to the costliest dues. Our post on negotiating with recovery teams may help.
- Check your credit report for errors. RBI directs credit information companies to give you one free full credit report each calendar year.
An illustrative example
This example is illustrative only and uses round numbers. Suppose a borrower has a personal loan EMI and two card dues, and the combined monthly outgo is more than the pay left after household costs. After two missed months, calls begin. The borrower writes down all dues, calls the lender, shares a short written request for a revised schedule and keeps paying a small amount towards the costliest due. Outcomes always depend on the facts and on the lender.
Where can you complain if the lender crosses the line?
First complain to the lender. RBI states that you can approach its ombudsman if the lender has not replied within 30 days or you are unhappy with the reply, and that filing a complaint under the RBI Integrated Ombudsman Scheme is free. If the issue is serious, speak to a lawyer. Nothing here is a reason to avoid lawful dues. Paying what you owe, on a workable plan, protects you most.
