They also restrict persistent recovery calls and calls before 8:00 a.m. or after 7:00 p.m. for overdue loans.

There is an important distinction, however. RBI rules do not create a simple universal rule saying that every contact with a relative is automatically illegal. The facts matter. A family member who is a co-borrower or guarantor can have a direct contractual relationship with the lender. A parent, spouse, sibling or friend who has no liability for the loan is in a different position. The safest question is therefore not just “Did they call my family?” but “Why was the person contacted, what was disclosed, and how was the contact used?”

Can banks legally call your family for loan recovery?

The short answer is: not as a general pressure tactic. RBI’s recovery-agent framework specifically prohibits regulated entities and their agents from using intimidation or harassment, publicly humiliating borrowers, or intruding upon the privacy of debtors’ family members, referees and friends. The same framework applies broadly to commercial banks, all-India financial institutions, NBFCs, primary urban and other specified cooperative banks, and asset reconstruction companies, subject to the stated scope and exclusions.

That means a recovery agent cannot treat a relative’s phone number as a licence to shame the borrower, pressure the relative into paying someone else’s debt, or disclose private account information simply because the borrower is overdue.

At the same time, the answer can change when the person contacted has a legal role in the credit arrangement. A co-borrower or guarantor may have obligations under the agreement. A reference contact is not automatically a co-borrower or guarantor merely because their number appears in an application.

Person contacted

Why the distinction matters

What to check

Borrower

Primary person responsible for the account

Account details, amount due, repayment options and lender identity

Co-borrower or joint borrower

May have contractual responsibility for the credit

Loan agreement and the person’s legal role

Guarantor

May have obligations under the guarantee

Guarantee terms and applicable liability

Family member with no contractual role

Does not become responsible merely because they are related

Whether the contact involved privacy intrusion, pressure or disclosure

Reference or friend

A reference is not automatically liable for the loan

What information was requested or disclosed and why

What does RBI actually prohibit during recovery?

RBI’s August 12, 2022 instructions are important because they place responsibility on regulated entities for the actions of their outsourced recovery agents. The directions specifically address intimidation and harassment, including verbal or physical conduct, public humiliation, intrusion into the privacy of family members, referees and friends, inappropriate messages, threatening or anonymous calls, persistent calling, calls before 8:00 a.m. or after 7:00 p.m., and false or misleading representations.

Recovery behaviour

RBI position

What you should do

Threatening or abusive language

Prohibited recovery conduct

Save the evidence and complain to the lender

Publicly humiliating the borrower

Prohibited recovery conduct

Record who was contacted and what was said

Intruding into family members’ privacy

Prohibited recovery conduct

Document the third-party contact and any disclosure

Threatening or anonymous calls

Prohibited recovery conduct

Preserve call records and caller details

Persistent recovery calls

Restricted under the recovery-agent directions

Maintain a dated call log

Calls before 8 a.m. or after 7 p.m.

Restricted for recovery of overdue loans

Record the exact date and time

False or misleading representations

Prohibited recovery conduct

Ask for the claim and authority in writing

These protections concern the method of recovery. A borrower can challenge harassment while still needing to address an overdue account.

Can a recovery agent tell your parents or spouse about your loan?

A recovery agent should not use family contact to publicly expose or pressure a borrower. RBI’s directions specifically refer to intrusion into the privacy of debtors’ family members, referees and friends. Earlier RBI guidance also stresses strict customer confidentiality and prohibits intimidation or harassment intended to humiliate or intrude on the privacy of family members.

This is why the information shared matters. There is a meaningful difference between a person receiving a message asking the borrower to contact the lender and a caller telling the person’s parents how much the borrower owes, how many days overdue the account is, or that the family must pay immediately.

If a relative was contacted, write down exactly what happened. Record the caller’s name, agency, number, date, time, relationship of the person contacted, and whether the caller disclosed an amount, account number, repayment history, salary information or other private information.

What if the family member is a co-borrower or guarantor?

This is one of the most important exceptions to understand. A family relationship by itself does not create loan liability, but a contractual role can.

If a spouse, parent, sibling or another person signed as a co-borrower, joint borrower or guarantor, the lender may have a legitimate reason to communicate with that person about obligations arising from the agreement. The exact rights and liabilities depend on the loan documents and the person’s contractual status.

Do not use a general “banks cannot call family” statement to assume that a guarantor or co-borrower has no responsibility. RBI’s rules focus on the conduct of recovery and specifically protect the privacy of family members, referees and friends. The circumstances and the person’s role matter.

If a lender says it contacted a relative because it could not reach you, ask the lender to explain the basis for the contact and what information was disclosed. If the person was merely a reference, record the contact and ask that future communication be directed to you through the lender’s official channels.

For regulated digital lending, RBI also requires grievance-redressal arrangements and places responsibility on the regulated entity even when lending service providers are involved.

What time can recovery agents call?

For the regulated entities covered by RBI’s August 2022 recovery-agent directions, recovery calls should not be made before 8:00 a.m. or after 7:00 p.m. The directions also address persistent calling and threatening or anonymous calls.

The timing rule is about recovery contact. It does not mean an overdue borrower can ignore a genuine account. It means the lender and its recovery agents must follow the applicable conduct requirements while pursuing the debt.

If your family member receives calls outside these hours, capture the call log or message timestamp. If the conduct involves suspected fraud or cybercrime, use the appropriate official reporting route.

Do not let a caller create artificial urgency by claiming that your family will be arrested, your property will be seized immediately, or a case has already been filed unless you have verified the claim through an official channel.

Does a family call mean a court case has been filed?

No. A recovery call to a borrower or relative does not by itself prove that a court case has been filed.

A genuine legal notice, arbitration communication or court document is different from an ordinary collection call. For a significant dispute or formal proceeding, consider obtaining legal advice.

Can recovery harassment cancel your loan?

Usually, a complaint about improper recovery conduct and the underlying repayment obligation are separate issues. RBI’s restrictions on harassment do not automatically cancel a genuine debt.

You can therefore make two tracks of action at the same time: challenge threats, privacy intrusion or improper third-party contact, while also asking the lender what legitimate repayment or resolution options are available.

If the account is genuinely overdue and you are struggling with multiple repayments, BillCut’s guide on prioritising loans when salary is low can help with the repayment-planning side of the problem.

What if you genuinely cannot pay the EMI?

Being unable to pay on time does not mean you should stop communicating with the lender.
